GENIUS Act application window likely will not open until July 2026

No one knows exactly when the federal application window for GENIUS Act stablecoin issuers will officially open. But it's hard to see it happening much earlier than the statutory deadline in mid-July 2026.

The Act mandates that the four primary federal payment stablecoin regulators issue regulations to carry out the licensing provisions and start accepting applications "before" July 18, 2026. It doesn't say how long before the deadline applications must be accepted, but the timeline is likely to be tight.

One reason is the interagency process. Under the Act, federal regulators must "coordinate, as appropriate, on the issuance of any regulations," suggesting joint rulemakings or, at minimum, aligned standards across agencies.

Interagency coordination makes rulemaking take longer, even when it involves agencies (like the bank regulators) that work on rules together routinely. The GENIUS Act adds the NCUA, which usually does its own versions of the rules that the banking agencies issue jointly.

Then there is the massive turnover the OCC and FDIC have experienced in the past couple of months. When new people have to figure out how to work together for the first time, things tend to slow down.

Another factor is the especially big to-do list facing the OCC, as the primary regulator for both federal qualified issuers and issuing subsidiaries of federally chartered IDIs. The agency has to develop new versions of its regulatory frameworks for nonbank federal qualified issuers while simultaneously adapting existing national bank procedures for stablecoin issuing applications.

With all these factors in play, it will be a challenge even to meet the statutory deadline, let alone finish early. If it weren't for the Administration's urgency around stablecoins, I would be surprised if the deadline were met at all.
